Comment on the Expropriation Bill and the Housing Consumer Protection Bill

You are invited to provide written submissions to the Western Cape Provincial Parliament, as well as verbal presentations on such written submissions, on two Bills, details below.

Expropriation Bill [B 23B–2020] (NCOP)

The purpose of the Bill is:

  • to provide for the expropriation of property for a public purpose or in the public interest;
  • to regulate the procedure for the expropriation of property for a public purpose or in the public interest, including payment of compensation;
  • to identify certain instances where the provision of nil compensation may be just and equitable for expropriation in the public interest;
  • to repeal the Expropriation Act, 1975 (Act 63 of 1975); and
  • to provide for matters connected therewith.

Housing Consumer Protection Bill [B 10B–2021] (NCOP)

The purpose of the Bill is:

  • to provide for the protection of housing consumers;
  • to provide for the continuance of the National Home Builders Registration Council as the National Home Building Regulatory Council;
  • to provide for the registration of homebuilders;
  • to provide for the enrolment of homes in order to be covered by the home warranty fund;
  • to provide for the regulation of the conduct of homebuilders;
  • to provide for the continuance of the home warranty fund;
  • to provide for claims against the fund;
  • to provide for the funds of the Council and for the management of those funds;
  • to provide for procurement and contractual matters in relation to the building of a home;
  • to provide for the enforcement of this Act;
  • to repeal the Housing Consumers Protection Measures Act, 1998 (Act 95 of 1998); and
  • to provide for matters connected therewith.
