City calls for Strict Monitoring of Fireworks

In terms of the Explosives Act (Act No 26 of 1956) the City of Cape Town has introduced measures to prevent and reduce fire hazards or other threatening dangers as result of the use of fireworks.

The City's By-law relating to Community Fire Safety, as amended, regulates the storage, use and selling of fireworks within the boundaries of the city.

All persons intending to sell, store or distribute fireworks (as defined in the Explosives Act) must be in possession of a valid Firework Certificate or Permit. The certificate entitles the holder to store, sell or distribute fireworks. The certificate is not transferable and is issued to a fixed property excluding buildings used for residential or part- residential purposes, which meets all the requirements as per the inspection carried out by an authorised Fire Service Official.

Dealers may not sell fireworks or allow or permit it to be sold to a child under the age of 16 years.

Any person who intends holding a public fireworks display must submit an application to the SA Police Services at least 14 days prior to the intended date of the display. After permission is granted from the SAPS he/she must apply for permission from the City of Cape Town if the site lies within the city.

Failure to comply with these regulations will result in prosecution as per the Criminal Procedure Act (Act 51 of 1977) of an offence and liable on conviction to a fine or imprisonment for a time not exceeding two years.
